The Supreme Court heard that Milorad “Michael” Trkulja was shot in the back in a St Albans restaurant in 2004.

Police said the shooting was not related to Melbourne underworld but Google’s automatic search software placed his photo alongside alleged criminals in the Google image listing.

Google had argued it was not the publisher of the photo but rather an innocent disseminator.

Justice David Beach ruled against Google and awarded $200,000 in damages for loss of reputation and hurt feelings.

Mr. Trahilla won a similar case against Yahoo! in March.
